Terms and conditions of the Online Store located at https://www.botanyo.com and https://www.botanyo.pl

1. General provisions

  1. These rules determine the principles of use of the online store BOTANYO, available at www.botanyo.com and www.botanyo.pl.
  2. The online store is operated by Botanyo Sp. z o. o. with its seat in Warsaw, Poland, at Dluga Street 29, 00-238, registered in the National Court Register XII Economic Department of the District Court for the Capital City of Warsaw under the number: 0001134878, NIP (Tax Identification Number): 5253022098, REGON (National Business Registry Number): 54000388.
  3. Contact with the store staff is possible at e-mail address: hello@botanyo.com or by phone at +48 222 95 1234 (Monday to Friday, 10 a.m. to 3 p.m.).
  4. Acceptance of Terms and Conditions is a condition of making a purchase in the store.

2. Definitions

  1. Customer – a natural person, legal entity or organizational unit that makes an order in the online store.
  2. Consumer – a natural person making a purchase for a purpose not directly related to his or her business activity.
  3. Seller – an entity operating an online store.
  4. Product – goods available in the online store for purchase.

3. Conditions for placing orders

    1. The store conducts sales via the Internet.
    2. Orders can be placed 24 hours a day, 7 days a week, through the store’s website.
    3. In the order form, the Customer is required to provide correct and truthful contact information.
    4. The Customer will receive a confirmation of his or her order acceptance via the e-mail address provided. The sales contract is concluded upon the receipt of this confirmation.

4. Prices and payment methods

  1. All prices of products listed on the site are gross prices (including VAT) and are expressed in Polish Zloty (PLN) or in Euros (EUR), depending on the Customer’s choice made by clicking on the prefered currency.
  2. The store reserves the right to change products’ prices, introduce new products to the store’s offer as well as conduct and cancel promotional campaigns.
  3. The Customer can make payment for the order by bank transfer, quick online transfer, or payment by credit card (Visa, Visa Electron, Mastercard, Mastercard Electronic and Maestro).
  4. The entity providing online payment services is Autopay S.A.

  5. The order processing time is counted from the moment of obtaining positive payment authorization. In the event that the Customer chooses payment by bank transfer, electronic payment or credit card – from the day of crediting the Seller’s bank account.
  6. If the order is not paid within 24 hours of its placement, the order will be canceled.

5. Delivery

    1. Products are delivered in the territory of Poland.
    2. Products are shipped within 48 hours from the moment of payment. Delivery time depends on the shipment method chosen by the Customer.
    3. The cost of delivery shall be paid by the Customer, unless the store provides for a promotion that includes free delivery.
    4. The Customer is obliged to check the condition of the shipment in the presence of the courier and report any damage.

6. Withdrawal from the contract and returns

    1. The Consumer has the right to withdraw from the contract without giving any reason within 14 days of the receipt of the order.
    2. To withdraw from the contract, the Consumer must send a statement of withdrawal to the e-mail address: hello@botanyo.com or by regular mail to the address of the company’s headquarters (Długa 29 Street, 00-238 Warsaw, Poland). Statement of withdrawal from the contract is attached as Appendix No. 1 to these Terms and Conditions.
    3. The product should be returned intact, together with proof of purchase and statement of withdrawal, to the address of the store.
    4. The Seller refunds the payment using the same method of payment that the Consumer used, unless the Consumer has expressly requested another method of refund that does not involve any costs for him.
    5. Refunds will be made within 14 days of the receipt of the returned products by the store.

7. Complaints

    1. The store undertakes every effort to provide their Customers products without any defects.
    2. If a defect in the goods is detected, the Customer has the right to file a complaint by sending a message to the e-mail address: hello@botanyo.com or by mail to the address of the company’s headquarters (Długa 29 Street, 00-238 Warsaw, Poland).
    3. The complaint should contain the Customer’s data, description of the defect and proof of purchase.
    4. The store will consider the complaint within 14 days of its receipt and will inform the Customer about further proceedings.

8. Protection of personal data

    1. By placing an order, the Customer agrees to the processing of his or her personal data for the purpose of processing the order.
    2. Customer’s personal data shall be processed in accordance with applicable laws and the store’s Privacy Policy.

9. Final provisions

    1. Terms and Conditions shall come into force on November 1, 2024.
    2. The store reserves the right to amend the Terms and Conditions. Amendments shall come into force upon their publication on the store’s website.
    3. In matters not covered by these Terms and Conditions, the provisions of the Polish Civil Code and other generally applicable laws shall apply.
    4. Terms and Conditions are available electronically on the store’s website and are provided to customers free of charge.
